When a crack on the windshield is detected, the police often issue fines. Let's try to understand when the police can impose a fine for a crack on the windshield.

Yes, according to Part 1 of Article 121 of the Code of Ukraine on Administrative Offenses (CUAO), driving a vehicle that has malfunctions with which its operation is prohibited entails a fine of 340 UAH.

In paragraph 6.8.5 of DSTU 3649:2010, it is stated that there should be no chips or cracks in the windshield of wheeled vehicles in the windshield wiper zone.

At the same time, DSTU 3649:2010 specifies that such damage does not fall under the category of technical malfunctions of the vehicle.

Thus, the current Road Traffic Regulations (RTR) do not consider a crack on the windshield as a technical malfunction that prohibits the operation of the vehicle. Therefore, the mentioned windshield issue refers to its damage rather than a technical malfunction of the car.

From this, it can be concluded that a crack on the windshield in the windshield wiper zone does not prohibit the use of the vehicle. Therefore, the driver cannot be held responsible, and such fines can be considered unlawful and challenged in court.
